Terms of service

Article 1. Scope of Application and Modification of these Terms of Use

  • This Agreement shall apply to all users as defined in Article 3.
  • 74 Inc. reserves the right to add, delete, or modify the contents of this Agreement without prior notice to the User.
  • All users shall confirm the contents of this Agreement when using the service defined in Article 2 (hereinafter referred to as "the Service"). 74, Inc. considers the user who uses the Service to have agreed to these Terms of Use.

 

Article 2. Services Provided

  • Services provided by 74 Inc. shall be the services listed below.
    • Goods sales service
    • Information service
    • Various services incidental to items 1 and 2
    • Various services that 74 Inc. will provide in the future.
  • 74 Inc. may add, delete, or change the contents of the services specified in each item of the preceding paragraph.

 

Article 3. User Definition

User" means a user of this Agreement and the Services.

 

Article 4. Formation of Purchase Agreement

  • The sales contract between the User and 74 Inc. shall be formed at the time specified in each of the following items.
    • In the case of an order from the Web Shop, the time when 74 Inc. receives the order information from the User.
    • In the case of an order from other than the Web Shop, the time when the order is accepted by 74 Co.
  • In the case of an application for the purchase of a product by a minor, the minor is deemed to have acted under the responsibility of his or her parent or guardian.
  • After the conclusion of the sales contract, 74 Inc. shall be entitled to invoice the User for the price (hereinafter referred to as "the price") based on the sales contract concluded between the User and 74 Inc. by the payment method specified in Article 6.1 when the User places an order. Ltd. shall be entitled to charge the User the price based on the sales contract concluded between the User and 74 Co.

 

Article 5. Cancellation of Contract

  • 74 Inc. may cancel the contract in the following cases after the conclusion of the sales contract.
    • When the ordered product is out of stock, and the delivery schedule is undecided.
    • When a product is damaged, broken, or otherwise defective prior to delivery, and there is no inventory, and the delivery schedule is undecided.
    • The manufacturer or supplier discontinues production of the product or is unable to supply the product.
    • The product cannot be delivered due to an unknown delivery address or long-term absence of the customer.
    • If the user fails to make payment within the specified period.
    • If the credit card company designated by the user is notified that the credit card is in default.
    • When it is impossible to deliver the product due to other reasons.
  • Notwithstanding the provisions of the preceding paragraph, 74 Inc. reserves the right to cancel or terminate the sales contract or take other appropriate measures in the event of fraudulent or inappropriate use of this service.

 

Article 6. Prices

  • The price of each product is clearly indicated on the product detail page and the delivery charge is indicated on the "Shipping Policy
  • page of the "Shipping Policy" page.
  • All prices and delivery charges are inclusive of consumption tax.
  • The delivery charges specified on the "Delivery Policy" page are based on the delivery method specified in Article 8.1.
  • 74 Inc. reserves the right to change product prices and delivery charges without prior notice to the User. Even if either or both of the product price and delivery charge are changed after the conclusion of the sales contract, the User shall pay the price as of the conclusion of the sales contract, and 74 Inc. shall not claim the difference to the User or refund the difference to the User.

 

Article 7. Settlement

The User may select one of the following payment methods at the time of purchase.

  • Credit card payment
  • PayPal


  • 74 Inc. reserves the right to add or delete the payment methods specified in the preceding items. 74 Inc. may request the User to pay by other payment methods if the User's credit card company notifies 74 Inc. that the User's credit card is in default.

 

Article 8. Product Delivery

  • Basically, for all orders, products shall be delivered by a route delivery company designated by 74 Inc. and all products shall be delivered in a packed condition at the eaves. The route service provider shall be selected at the discretion of 74, Inc. based on the size, weight, and nature of the merchandise.
  • In the event that the size, weight, nature, or delivery route of the product prevents delivery by a route delivery company, or in the event that the user requests a delivery method other than route delivery, such as chartered delivery, which incurs delivery costs higher than the delivery costs at the time the sales contract is concluded, 74 Co. 74 Inc. may invoice the User for the difference in delivery charges.
  • The User may change the delivery address of the products specified at the time of order by notifying 74 Inc. before 74 Inc. starts to arrange for product shipment. 74 Inc. is not obligated to comply with the User's request if the User contacts 74 Inc. to change the delivery address after 74 Inc. has started to arrange for the delivery of the products, and the User shall change the delivery address at his/her own responsibility and expense.
  • If the User wishes to have products shipped to multiple delivery addresses, the User shall place one order per delivery address. User may not order multiple items for one delivery address at one time and then request 74 Inc. to deliver each item to multiple delivery addresses after placing the order.
  • The User may specify that the products be delivered to a place other than the User's place of residence. If the User does not receive the products himself/herself, the User shall notify the delivery address or the recipient in advance that the products will be delivered by 74 Co. If a product is returned to 74 Inc. due to the user's carelessness, such as refusal to pick up, long-term absence, etc., and the product is delivered again at a later date, the user shall pay 74 Inc. the actual shipping costs for the return shipping and re-delivery.
  • Unless there is an announcement of gift wrapping, a gift wrapping label, a message card, etc. for the product in a campaign, etc. of 74, the User may not request 74 to provide such services.
  • The period of time from the start of product shipping arrangements until the product is delivered to the User shall be the period specified in each of the following items, except as specified in the following paragraphs.
    • For domestic delivery: Normally, approximately 2 to 9 days after the order is placed.
    • For international delivery: Varies depending on your location and the service of the delivery company in your area.
  • The period of time for product delivery may be extended for reasons specified in the following items.
    • When the product shipment cannot be made due to a holiday or our company's holiday falling on Saturday or Sunday.
    • When the shipment cannot be made as scheduled due to the shipping volume of the manufacturer or supplier, or other workload.
    • When the delivery is delayed due to circumstances on the part of the delivery company after the product has been shipped.
  • If the user is not available on the delivery date and the courier takes the product home without delivering it and leaves a "notice of absence", the user shall contact the courier himself/herself and arrange for redelivery of the product.
  • 74 Inc. shall not be liable for any direct or indirect damage to the User due to the delay in delivery of the Product to the User in accordance with the proviso of Paragraphs 10 and 11, or for any other reason.

 

Article 9. Transfer of Ownership

  • Ownership of the ordered products shall be transferred from 74 Inc. to the User upon receipt of the ordered products by the User or the delivery address designated by the User.
  • If you choose to pay by credit card, the credit card company may retain ownership of the products in your order in accordance with the terms and conditions of the membership agreement stipulated by the credit card company.

 

Article 10. Returns and Exchanges

  • The User shall not be able to change to another product, change specifications, cancel, or return or exchange products for the User's convenience after the conclusion of the sales contract for all orders.
  • The User shall check for damage, etc. without delay after receiving the merchandise.
  • In the unlikely event that the merchandise is damaged, defective, or the wrong item is found, the User shall notify 74 Inc. of the details within 7 days of receipt of the merchandise. In this case, the user shall keep the merchandise in the same condition in which it was packaged at the time of delivery. If 74 Inc. recognizes the damage, defect, or wrong item within this period, 74 Inc. will repair or replace the product with a new one at its own expense. However, if the product cannot be exchanged or repaired because it is a sold-out, discontinued, or limited edition item, the user will be refunded the product price.

 

Article 11. Handling of Personal Information

74 Inc. shall handle personal information of users in accordance with the "Privacy Policy" separately stipulated.

 

Article 12. Copyrights, etc.

The documents, images, sounds, and other copyrighted works provided by 74 Inc. on this service are protected by copyright law, other laws, and international treaties. Reproduction, diversion, transmission, screening, or other use of the contents, in whole or in part, as is or modified, without the Company's permission is prohibited, regardless of the media or means used. Furthermore, no alteration, modification, or revision of the content is permitted.

The user may not use or disclose any information, including copyrighted works, provided through 74 Inc. beyond the scope of the user's personal use as stipulated by the Copyright Law without the consent of the rights holder. In the event that a problem related to intellectual property rights such as copyrights arises in violation of the provisions of this Article, the User shall resolve the problem at his/her own expense and responsibility and shall not cause any trouble or damage to 74 Inc.

 

Article 13. Prohibitions

The User shall not engage in any of the following acts

  • Criminal acts, acts offensive to public order and morals, and other acts that violate or may violate laws and regulations.
  • Any act that interferes or may interfere with the operation or business of 74 Inc.
  • Actions that damage the reputation of 74 Inc. or a third party, or that cause or may cause annoyance, disadvantage, or damage to 74 Inc. or a third party.
  • Acts of using the Service by illegally using a third party's personal information or false information.
  • Actions that violate or may violate these Terms of Use or the "Membership Agreement" separately stipulated by 74 Inc.
  • Other acts that 74 Inc. deems inappropriate.

 

Article 14. Other Disclaimers

  • 74 Inc. shall be free to change, delete, or add to the structure, contents, web pages, and other aspects of the website, and shall not be obligated to return the website to the state it was in before any changes, deletions, or additions were made at the request of the user. The same shall also apply to EC systems in general, including programs and databases.
  • The User shall bear all costs related to the preparation and installation of computer equipment, communications equipment, etc. necessary to use the Service, telephone and fax charges, Internet connection fees, communications charges such as line usage fees, labor costs, and any other costs incurred in using the Service.
  • In the event that the user's data is lost or becomes illegible due to malfunction or trouble with 74's computer equipment or telecommunications equipment used to provide this service, or due to communication line failure, 74 may immediately and unconditionally cancel or terminate the sales contract without notice and without demand. 74 Inc. may unconditionally and immediately cancel or terminate the sales contract without notice or demand.
  • If the User causes any damage to another User or a third party by using the Service, the User shall settle the matter at the User's own responsibility and expense, and shall not cause any trouble or damage to 74 Co.
  • 74 Inc. shall not be liable for any damage caused by the User's inability to use the Service.
  • 74 Inc. shall not be liable for any damage, loss, or disadvantage caused by the use of the Service in any case, regardless of the legal cause of claim.
  • 74 Inc. shall be exempted from any liability by processing the business according to the information that the user has registered or communicated to 74 Inc. through this service.

 

Article 15. Miscellaneous

  • The formation, validity, performance, and interpretation of this Agreement shall be governed by the laws of Japan.
  • If any problem arises in connection with the use of the Service that cannot be resolved under these Terms of Use, the User and 74 Inc. shall discuss and resolve the problem in good faith.
  • If a lawsuit becomes necessary in connection with the use of the Service, the Tokyo Summary Court or the Tokyo District Court shall be the court of exclusive jurisdiction in the first instance, regardless of the amount of the suit.
